Quick summary (important)

• No account required. We aim to minimize personal data.
• Payment starts the fax submission. Fax delivery is asynchronous and depends on the recipient’s fax line and telecom routing.
• No guaranteed outcome. We provide transmission results based on the recipient fax line response, but fax technology cannot guarantee reading/processing by a person.
• Auto-deletion. Uploaded documents are deleted automatically according to our retention rules (see Privacy Policy).

1. Scope

These Terms apply to the GoFaxNow website, related pages, and the fax submission and delivery status functionality. Additional policies may apply where referenced (e.g., Privacy Policy).

2. The Service (how it works)

GoFaxNow enables you to submit a document to be faxed to a recipient fax number. After payment, your fax is queued and a delivery attempt is initiated via our telecom providers. Delivery can take several minutes and may succeed or fail depending on factors outside our control (e.g., busy lines, incompatible fax endpoints, call drops, routing issues).

You may receive (or view) a status result such as “Submitted”, “In progress”, “Delivered”, or “Failed”. Any result is based on the recipient fax line response and carrier signals—not a guarantee that the recipient read, processed, or acted on the document.

3. Acceptable use

• You must use the Service only for lawful purposes and in compliance with applicable laws and regulations.
• You must have the right to send the content you upload, and you are responsible for its accuracy and legality.
• No abuse, interference, reverse engineering, probing, or attempts to bypass security measures.
• No use to transmit unlawful, harmful, infringing, deceptive, or abusive content.

4. Your inputs (documents & numbers)

You are responsible for providing the correct recipient fax number (including country code) and for ensuring that the document is suitable for fax transmission. If a number is incorrect or the recipient endpoint is not a fax line, delivery may fail.

5. Pricing & payment

Fees are shown at checkout. Payments are processed by third-party payment providers (e.g., Stripe). Taxes may apply depending on your location and applicable law.

Important: Payment confirms your purchase of a fax submission attempt. It does not, by itself, confirm successful delivery.

6. Third-party services

The Service relies on third-party providers (e.g., telecom carriers and programmable fax infrastructure) to route calls and attempt delivery. Outages, carrier routing decisions, endpoint limitations, and protocol issues can affect outcomes.

7. Privacy & data retention

We aim to minimize personal data and automatically delete uploaded documents after a short period. Details on what we process, legal bases, and retention are described in our Privacy Policy.

8. Availability

We may change, suspend, or discontinue parts of the Service, and we may impose reasonable limits to protect security, prevent abuse, and ensure reliable operation.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis, to the extent permitted by law. We do not warrant uninterrupted operation, error-free transmission, or that any fax will be delivered or read by a recipient.

10. Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities.

Where liability cannot be excluded, our liability is limited to typical foreseeable damages and, in any case, capped at the amount you paid for the specific fax submission that gave rise to the claim, unless mandatory law requires otherwise (e.g., intent, gross negligence, or injury to life, body, or health).

Mandatory consumer protection rights and mandatory statutory liability rules remain unaffected.

11. Indemnification

You agree to indemnify and hold GoFaxNow harmless from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your uploaded content, or your violation of these Terms or applicable laws.

12. Termination

We may suspend or terminate access if we reasonably believe you violate these Terms, misuse the Service, or create security or legal risk. You may stop using the Service at any time.

13. Governing law & venue

These Terms are governed by the laws of Austria, excluding conflict-of-law rules. If you are a consumer, mandatory consumer protection laws in your country of residence remain applicable. Venue is the competent court as permitted by law.

14. Changes to these Terms

We may update these Terms from time to time. The “Last Updated” date indicates when changes were published. If changes materially affect your rights, we will take reasonable steps to provide notice.
